These Terms of Service ("Terms") govern your use of the Audio Upscaler: HD Voice application ("the App") published by Bulpara, Inc. ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

Audio Upscaler is an iOS application that performs neural audio bandwidth extension — it regenerates the high frequencies that a recording is missing, turning muffled, tinny, or low-bitrate audio toward crisp 48 kHz HD. Upscaling runs on your device using Core ML models. Features include in-app recording, audio file import, video clip processing (the audio track is upscaled and remuxed back into the original video without re-encoding the video), a before/after A/B compare with a dual spectrogram, a free Standard HD model, and an optional higher-fidelity Studio HD model with a wet/dry blend control for Premium subscribers.

2. Important Limitations

Audio Upscaler is an enhancement tool, not a guaranteed restoration service. You understand and agree that:

• The App regenerates plausible high-frequency detail based on the input signal; it does not recover the exact original audio that was lost and does not invent words or content that is not present.
• The App is optimized for voice and speech. Results on music or complex non-speech audio may vary; the Studio HD model handles low-bitrate audio and music better but is not a mastering tool.
• Output quality depends on the original recording's noise floor, bitrate, microphone, and how much high-frequency content was lost.
• Very low-quality or heavily distorted inputs may produce audible artifacts or "sizzle"; the wet/dry blend (Premium) can reduce this.
• Video processing replaces only the audio track of your video; the visual portion is preserved bit-for-bit and is not modified.
• The App is not a replacement for professional audio engineering or studio post-production.

3. Acceptable Use

You agree to use the App only for lawful purposes and only on audio you have the right to process. You agree not to:

• Process recordings of other people without their knowledge or consent where required by law
• Use the App to misrepresent, fabricate, or alter audio for fraud, impersonation, or deception
• Reverse engineer, decompile, or extract the bundled or downloaded machine-learning models
• Attempt to circumvent subscription restrictions or free-tier limitations
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. 1 upscale per day, up to 60 seconds per clip, the Standard HD model, and an unlimited before/after preview, with banner and interstitial advertising.
• Premium Monthly: $8.99/month. Unlimited upscales, the Studio HD model, video audio upscaling, wet/dry blend control, longer clips, batch processing, and zero ads.
• Premium Annual: $39.99/year (save vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• Subscriptions are billed through the Apple App Store and are subject to Apple's Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during a free trial period before the trial ends, you will not be charged.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers retain their original price for the remainder of the active term.

5. User Content

Recordings, upscaled files, and history are stored locally on your device. You retain all rights to your audio and video. We do not access, collect, or store your content on any server.

6. Intellectual Property

The App, including its design, code, and packaged content, is owned by Bulpara, Inc. and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose. The bundled and downloaded machine-learning models are licensed for use within the App only and may not be extracted or redistributed.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT UPSCALING RESULTS WILL MEET YOUR EXPECTATIONS FOR A SPECIFIC RECORDING.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Decisions made based on an upscaled recording (publication, broadcast, distribution)
• Audio quality of upscaled outputs, including any artifacts introduced by the models
• Loss of original recordings due to user error or device failure
• Subscription-related charges that fall under Apple's billing policy

9. Indemnification

You agree to indemnify and hold harmless Bulpara, Inc. from any claims, damages, or expenses arising from your use of the App, including any audio you process and distribute.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
